The following General Terms and Conditions (GTC) regulate the use of the platform www.casa-doe.com (hereinafter “casa-doe”). The casa-doe service is free of charge for you as a user.

The GTC apply to the use of the platform at www.casa-doe.com and all associated sub-pages. The GTC also apply if you access casa-doe or parts of it from other websites that allow access to www.casa-doe.com in whole or in part.

1. Object and contract partner

1.1. casa-doe is an online platform for market and customer research projects and offers you, as a registered user, the opportunity to participate in market and customer studies.

1.2 A consumer is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor to his self-employed professional activity.

1.3 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity.

1.4 The contracting party is Carsten Sander (hereinafter “casa-doe”), Germaniastrasse 10a, 34119 Kassel, Germany, e-mail: sander@ir-a.de.

2. Registration

2.1 To participate in casa-doe, you must first register. When registering, you must complete the registration form completely and truthfully. The required information can be found in the self-explanatory registration form. In this context, you must also accept these General Terms and Conditions and confirm that you have read and understood the data protection provisions.
Since casa-doe uses the service of cint, an analysis exchange service based in Germany, Friedrichstraße.60, 10117 Berlin in the form of an embedding (iFrame), you must agree to casa-doe’s general terms and conditions as well as cint’s general terms and conditions and confirm their data protection provisions in order to participate in casa-doe. You can view cint’s terms and conditions and privacy policy at the appropriate place by clicking on the respective link.

2.2 Registration is the basic requirement for participation in market and customer research projects.

2.3. casa-doe manages the profile data and study participations for registered members. This also includes the dispatch of invitations as well as credit overview and payment. The studies are conducted either by casa-doe itself or by study organisers who are allowed by casa-doe to select and invite participants based on anonymous profile information. In most cases, these are market research institutes, management consultancies or companies that offer services and products to be tested. In the case of studies that are not conducted by casa-doe itself, the invited members are forwarded to the questionnaires. In most cases, the client can be identified by a logo or in the introductory text of the study. In some cases it is important not to know the client in order to be able to participate in a study as impartially as possible. In this case, the client cannot be identified or cannot be clearly identified.

2.4 You are obliged to provide all information in the registration process completely and truthfully.

2.5 Registration may only take place once per participant. If an account was deleted before, a registration can take place again, whereby you may register again only once.

2.6 Registration is only permitted for persons who are at least 16 years of age. casa-doe reserves the right to check the age information in cases of doubt. If you are under 16 years of age, you may only register with casa-doe if your legal guardians have agreed. An appropriate declaration must be sent to casa-doe together with the registration without request.

2.7 After completing the registration process, casa-doe will send you a confirmation e-mail. This e-mail contains a link that you must click to complete the registration process (so-called “double-opt-in”).

2.8 Upon completion of the registration process, the user contract with casa-doe, which is free of charge for you, has been concluded.

2.9 Inputs can be corrected and/or changed at any time using the forward and backward function in the browser.

2.10. The contractual language is German.

3. Studies/ polls

3.1 If a study is commissioned or organized by casa-doe, casa-doe invites registered users by e-mail to the e-mail address provided during the registration process. Your e-mail address also represents the user name for the login. A valid and current e-mail address is therefore an absolute prerequisite for your membership.

3.2. casa-doe only sends out invitations to a study to those participants who are most suited to the requirements and the target group of the respective survey/study. You are not entitled to participate in a particular survey/study or to regular invitations. Of course, you are not obliged to take part in a survey/study.

4. Duties of the participants

4.1 As a registered user of casa-doe, you must always keep your data in your user account up to date. In addition, you should fill out your profile as completely as possible to enable a more precise target group identification. To ensure that it is up-to-date, casa-doe reserves the right to send a reminder e-mail to all users every six months.

4.2 As a participant in casa-doe, you are obliged to answer the questions within a survey/study truthfully and completely. In order to guarantee a high quality standard, casa-doe reserves the right to exclude participants from casa-doe should there be repeated complaints about the quality of participation.

4.3 Many questionnaires have mechanisms to check the quality and consistency of the answers. If participants notice a lack of quality or inconsistencies/ inconsistencies in their answers or response behaviour, they will be warned and, if necessary, excluded from casa-doe.

4.4. casa-doe reserves the right to reverse credits already booked if surveys were intentionally answered incorrectly or if manipulations can be subsequently detected at the end of the survey.

4.5 Please make sure that you always fill out questionnaires completely, correctly and at a realistic speed. Because incomplete, incorrect and/or too slow or too fast completed questionnaires cannot be used and thus lead to exclusion. A right to credit expires with exclusion and credits already made will be deducted in this case.

4.6 You may only participate in a survey once at a time. It is forbidden to participate in a single survey several times by circumventing security precautions, multiple registrations etc. casa-doe reserves the right to exclude participants who violate the GTC from casa-doe. In this case any credits expire.

4.7 By registering with casa-doe, you undertake not to store or pass on to third parties any information, documents or material, such as content from the questionnaires, e-mails, surveys, product tests, other market research activities etc., to which you have had access in the context of surveys/ studies/ projects. This includes all types of questions, images, templates or content. If violations occur, casa-doe can demand compensation for damages incurred from the respective participant and at the same time also exclude the participant from casa-doe.

4.8 As a registered participant you also commit yourself not to pass on your access data to other persons. In addition, you may not allow other people to participate in the surveys on your behalf. casa-doe cannot accept any responsibility for unauthorized use of your user account in this respect.

4.9 As a registered user, you must not use any algorithms, mechanisms, software or other aids in connection with the use of casa-doe that restrict or hinder the functionality or accessibility of casa-doe. It is forbidden to change, overwrite, delete or manipulate content sent by casa-doe in any other way. Violations can lead to the termination of your membership at casa-doe. We reserve the right to assert further claims.

5. Remuneration

5.1 You will receive a credit for every complete and duly completed survey, which will be charged to your user account. The amount results from the invitation e-mail. Should the completion time increase or decrease differently than estimated before the start of the project, the reward amount will be adjusted accordingly for the entire study.

5.2 You can check the current status in your user account.

5.3 The credits will be paid out if you have collected at least 10 €. If you are from Switzerland, the minimum amount for a withdrawal is 15 SFR. For participants from England, the minimum payout is £10 and if you are from Australia, the minimum is $10. To withdraw, you must first log into your account and check your balance here. Once your account balance has reached the minimum payout limit, you can request a PayPal transfer or Amazon voucher to the amount of the payout limit at the touch of a button. This request arrives at our partner cint (see point 2.1.) and is executed either in real time or with a delay of 2-3 days.

5.4 If you have not carried out a survey completely and/or truthfully, no credit note will be issued or credit notes already issued can be reversed in the event of the aforementioned violations.

5.5 As a rule, the actual survey is preceded by so-called filter questions. This serves the purpose of determining whether you as a participant belong to the target group or not. If you do not belong to the target group, the survey will be cancelled. In this case no remuneration will be credited. A questionnaire can also be completed if certain quotas have already been met (e.g. age groups/localities etc.). No credit is issued in this case either. If the average pre-interrogation time of about 3 minutes is exceeded, compensation can be credited to your account, despite disqualification.

5.6 As a rule, the credits do not expire. However, something different applies if you have been excluded from casa-doe due to a violation of these Terms of Use or the client’s terms and conditions of the respective survey or if you have been inactive for more than 24 months and it is therefore unlikely that you will reach the minimum limit for withdrawals (see item 5.3.). The credits also expire if you log out of casa-doe / delete your account without having reached the payout limit in advance.

6. Privacy

6.1 casa-doe attaches the highest priority to data protection as a reputable German market research company. You can find more detailed information in our privacy policy.
At this point, however, it should be noted that for some surveys/studies personal data are necessary in order to select the target groups that the client needs. In no case casa-doe passes on personal data to the client. Rather, personal data is always made anonymous before it is passed on. A conclusion on you is therefore not possible by the client.

7. Termination/deletion

7.1 If you wish to terminate your membership of casa-doe, you can do so at any time and without giving reasons in text or written form (account, e-mail, letter). You do not have to observe a deadline.

7.2 You can cancel your membership immediately after logging into your account by deleting your registration or terminating your membership. Alternatively, you can send the cancellation to the address / e-mail address given in the imprint.

7.3 Upon termination of your membership, your data will be deleted immediately if and to the extent that the purpose of data processing has ceased and no legal retention obligations exist.

7.4 Once you have reached the payout limit, you should definitely withdraw your credit before deleting your account (see point 5.3.). Otherwise your credit will expire when you delete your account.

7.5. casa-doe reserves the right to terminate your registration or registration with casa-doe with three days’ notice. This can happen in particular if you have been inactive for a longer period (at least 12 months) despite invitations to surveys.

7.6 The right to extraordinary termination remains unaffected by this.

7.7 If invitation e-mails cannot be delivered because the e-mail address no longer exists, casa-doe reserves the right to delete the user account concerned after 30 days. The same applies if deliveries do not work because storage limits have been exceeded or there are other permanent bounces. Any credit expires in these cases.

7.8 If you do not respond to e-mail invitations from casa-doe for more than 12 months, your status will automatically change to “inactive”. If you do not log in to casa-doe within 24 months after this status change or if you do not register by e-mail within 24 months, your user account will be deleted immediately. Any credit expires in this case.

8. Warranty, Liability, Revocation

8.1 The statutory warranty rights apply.

8.2. casa-doe is not responsible for the content and correctness of your details in the registration and profile data and other content generated by you. casa-doe accepts no liability for any misuse of information.

8.3 The liability of casa-doe for damages is excluded. This does not apply to claims for damages arising from injury to life, body or health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by casa-doe or an intentional or negligent breach of duty by a legal representative or vicarious agent of casa-doe. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. casa-doe is not responsible for achieving any particular economic success.

8.4 In the event of a breach of essential contractual obligations, casa-doe shall only be liable for the foreseeable damage typical for the contract if this was caused by ordinary negligence, unless it concerns claims for damages arising from injury to life, body or health.

8.5. casa-doe is not liable for unauthorized access and knowledge of personal user data by third parties (e.g. by “hacking”). Similarly, casa-doe is not liable for the misuse of information by third parties if you have made this information accessible to the third party yourself.

8.6 Despite generally high security standards and constantly updated software and security updates, casa-doe cannot guarantee that the online platform is accessible without interruption and/or free of errors or viruses. Furthermore, casa-doe does not guarantee that the information within the online platform is error-free and/or complete.

8.7 Consumers may have a statutory right of revocation. casa-doe will give a separate lecture on this. Entrepreneurs are not granted a voluntary right of withdrawal.

9. Change in terms of participation

9.1 In order to meet our standards and to always be able to suggest current surveys and studies to you, casa-doe reserves the right to add new functions and/or extend existing functions. In this case it may be necessary for casa-doe to renew/change these GTC accordingly, which we also reserve the right to do so. This also applies if there are legal changes that force casa-doe to make an adjustment. If the General Terms and Conditions change due to new and/or changed functions or due to legal requirements, casa-doe will inform you by e-mail with a period of four weeks before the new/changed General Terms and Conditions become effective. You then have the opportunity to object to the validity of the new/changed terms and conditions within these four weeks by replying to the e-mail. If there is no objection within this period, the new/ amended GTC shall be deemed confirmed.

10. Copyright and other property right

10.1 The platform and all associated sub-pages are the intellectual property of casa-doe and are operated by casa-doe.

10.2 casa-doe is either the owner or licensee of all trademarks, logos and other signs, unless provided by the customer. You are not entitled to use images or the like on the online platform or in e-mails without casa-doe’s express written consent.

10.3 Duplication, distribution, modification or use of the content for purposes other than personal, non-commercial purposes is only permitted with the prior written consent of casa-doe.

11. Third-party reference

11.1 casa-doe is entitled to commission third parties with the provision of parts or the entire range of services offered by casa-doe.

12. OS platform and dispute resolution

Online settlement of disputes in accordance with Art. 14 para. 1 ODR-VO: The European Commission provides an online dispute resolution (OS) platform, which you can find at http://ec.europa.eu/consumers/odr/

13. Jurisdiction and Choice of Law

13.1 The registered office of casa-doe is agreed as the place of jurisdiction for entrepreneurs.

13.2 German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

13.3 Pursuant to Article 6(2) of Regulation No 593/2008 (“Rome I”), this Choice of Law Agreement does not deprive a consumer of the protection afforded to him by the mandatory consumer law of the country in which he has his habitual residence, provided that casa-doe pursues his professional or commercial activity in that country or in any way directs such an activity towards that country or several countries, including that country, and that the contract falls within the scope of such activity.

Our clients receive the information that you have provided in the course of studies and other, primarily socio-demographic information about yourself, exclusively in anonymous form for statistical evaluation.

In case of important changes, for example for technical reasons, I will inform you by e-mail. The e-mail will be sent to the address you entered in your profile data.
The data entered during registration will be processed on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). A revocation of your already given consent is possible at any time. For this purpose, an informal notification by e-mail is sufficient. The legality of the data processing already carried out remains unaffected by the revocation.

We store the data collected during registration during the period you are registered on our website. The data will be deleted if you cancel your registration. Your personal data will be deleted after the completion of ongoing projects, if this is still required. Legal retention periods remain unaffected.
